AI Output Disclaimer & Content Guidelines

This AI Output Disclaimer & Content Guidelines (“Disclaimer”) explains the nature of AI-generated content on the neo-fashion.ai platform (“Service”) operated by Fipera Trading F.Z.E (“Fipera”, “we”, “us”, “our”), and your responsibilities before using generated images and video (“Output”) commercially.
This Disclaimer supplements the Terms of Service §6 and the Acceptable Use Policy. Capitalised terms not defined here have the meanings in the Terms.
1. Nature of AI generation
1.1 The Service uses probabilistic machine learning models to generate visual content from your prompts, reference images, personas, and brand-trained models.
1.2 Output is not deterministic. The same inputs may produce different results across generations. Details such as garment fit, background elements, text in scene, hands, and fine texture may vary or contain artefacts.
1.3 AI models reflect patterns in training data and your reference set. They do not guarantee factual accuracy, legal compliance, or uniqueness.
2. No warranty on Output
2.1 Output is provided “as is” without warranty of any kind, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.
2.2 Fipera does not warrant that Output is:
- Free from errors, distortions, or offensive elements;
- Unique or absent from third-party works;
- Suitable for any specific channel (print, OOH, broadcast) without your verification;
- Legally cleared for use with real-person likenesses, trademarks, or copyrighted designs.
2.3 To the extent permitted by law, Fipera’s liability for Output is limited as set out in the Terms.
3. Your review obligation
You must review all Output before publication or commercial use.
3.1 Establish an internal QA process appropriate to your risk — especially for e-commerce PDP images, advertising, and packaging.
3.2 Check for: incorrect garment details, colour drift, anatomical artefacts, unintended logos or text, background elements that imply false endorsements, and compliance with your brand guidelines.
3.3 For regulated claims (sustainability, sizing, material composition), do not rely on AI Output as evidence — use your approved product data.
4. Intellectual property and brand clearance
4.1 You are responsible for ensuring Output does not infringe third-party intellectual property, including trade dress, logos, prints, and photographic works.
4.2 Trademarks and brand names visible in Output may appear incidentally. Remove or regenerate before use if clearance is uncertain.
4.3 Custom models trained on your reference images inherit patterns from those images. You represent that training data is properly licensed. See Terms §5.
5. Personas, likeness, and talent rights
5.1 Synthetic personas created without reference to real individuals are subject to your brand guidelines and applicable publicity laws in markets where you publish.
5.2 Real-person personas require appropriate model release and consent. You are solely responsible for obtaining and retaining documentation.
5.3 Do not use Output to imply endorsement by individuals, celebrities, or organisations without authorisation.
6. Prohibited outputs
Output must not be used to create or distribute content prohibited under the Acceptable Use Policy, including:
- Non-consensual intimate or deceptive imagery of real persons;
- Content sexualising minors;
- Illegal, harassing, or hate-promoting material;
- Fraudulent product representations.
We may suspend accounts that generate or publish prohibited content.
7. Disclosure and labelling
7.1 Some jurisdictions require disclosure when images are AI-generated or synthetically altered, particularly in advertising and political contexts.
7.2 You are responsible for compliance with labelling rules in each market where Output is published.
7.3 Fipera does not provide legal advice on disclosure requirements. Consult qualified counsel for campaign-specific guidance.
8. Third-party platform policies
Marketplaces, social networks, and ad platforms may impose additional rules on AI-generated content. You are responsible for compliance with destination platform policies (Meta, Google Ads, Amazon, etc.).
9. Human creative direction
9.1 The Service is a production tool, not a replacement for creative direction, art direction, or legal review.
9.2 We recommend retaining human oversight for campaign work, talent casting decisions, and final sign-off — consistent with industry practice for high-stakes brand assets.
10. Reporting issues
If you believe Output was generated in error due to a platform bug (not aesthetic preference), contact legal@neofashion.ai with generation ID, timestamp, and description. Credit refunds for failed generations are handled per our credit policy in the Terms.

11. Changes
We may update this Disclaimer as AI capabilities and regulations evolve. Material changes will be posted on this page.
